A Note on Customer Hosted Data: As a hosting provider, we act as a data processor for the content you host with us. We treat this data as strictly confidential. We do not generally inspect, use, or share your hosted files, applications, or databases unless explicitly requested by you for technical support, to maintain server integrity, or to comply with a binding legal order. However, we do utilize automated filters to detect outbound spam and will actively inspect files and server activity to investigate reported abuse cases or violations of our Terms of Service.


2. How We Use Your Information

We process your data based on legitimate business interests, the fulfillment of our contract with you, your consent, or legal obligations. We use your data to:

  • Provide Services: Facilitate account creation, fulfill orders, process payments, and manage your active hosting services.
  • Communicate: Send administrative information, respond to support inquiries, and request feedback.
  • Ensure Security: Monitor for fraud, protect our Website, and enforce our terms and policies.
  • Improve the Platform: Analyze usage trends and evaluate site performance (using anonymized/aggregated data where possible).
  • Legal Compliance: Respond to legal requests, court orders, and prevent harm.

We do not sell, rent, or trade your personal information. We only share your data in the following specific circumstances:

Third-Party Service Providers We share necessary data with trusted third-party vendors who perform services on our behalf. We have strict data processing agreements in place with these parties:

  • Datacenters & Infrastructure: Hetzner, OXXA (Server Data & Domain Registry)
  • Payment Processors: Mollie, PayPal
  • Analytics: Speetjens Analytics (Our self-hosted, privacy-focused, cookie-free infrastructure. Data remains entirely in-house and is never routed through external advertising networks.)
  • Customer Reviews: Trustpilot

Business Transfers Your data may be transferred during negotiations of any merger, sale of company assets, financing, or acquisition.

Legal Obligations & European e-Evidence Orders We will disclose your information if legally required to do so by applicable law, court order, or governmental request.

  • European e-Evidence Orders: Under Regulation (EU) 2023/1543, we are legally obliged to respond directly to data preservation or production orders from foreign EU judicial authorities within strict deadlines (often 10 days, or 8 hours in emergencies), without prior intervention by a Dutch court.
  • Gag Orders: If we receive such an order, we may be legally prohibited from informing you about the disclosure to protect ongoing criminal investigations. By using our services, you acknowledge your data is subject to cross-border legal requests.

4. Cookies & Tracking Technologies

We use a minimal number of cookies to ensure our site and client portal function properly. All first-party cookies set by our website are strictly functional and required for the service to operate.

Note: We currently do not respond to Do-Not-Track (DNT) browser signals, as no uniform technology standard has been finalized.


5. Data Retention & Security

We only keep your personal information for as long as you have an active account, unless a longer retention period is required by law (e.g., tax or accounting requirements).

Security Measures & Encrypted Backups While no electronic transmission is 100% secure, we implement robust technical safeguards to protect your data:

  • Snapshot Technology: We securely capture the state of our servers every 12 to 24 hours.
  • End-to-End Encryption: All backup archives are strictly encrypted before leaving our servers and remain unreadable at rest in off-site storage.
  • Retention Tiers: Daily backups are kept for 7 days; weekly backups for 4 weeks; monthly backups for up to 6 months. Older archives are automatically and permanently destroyed.

6. Your Privacy Rights

Depending on your region, you have specific rights regarding your personal data. We will respond to all verified data requests within 30 days.

General & European (EEA/Swiss) Rights:

  • You may request access to, correction of, or deletion of your personal data.
  • You may object to or restrict our processing of your data.
  • You may withdraw your consent at any time (this does not affect processing done prior to withdrawal).
  • If you believe we are unlawfully processing your data, you may complain to your local data protection authority (EEA Authorities | Swiss Authorities).

California Resident Rights (CCPA/Shine the Light):

  • You may request information, once a year and free of charge, regarding the categories of personal data we disclosed to third parties for marketing purposes in the prior calendar year.
  • If you are under 18, you may request the removal of unwanted data you publicly posted on the Website.
