1. Introduction & Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," "you") and Cubes Hosting ("Cubes Hosting," "we," "us," "our"). By registering an account, purchasing, or utilizing any of our products and services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as all applicable laws and regulations. If you do not agree to these Terms, you are strictly prohibited from using our services.
We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to this page, with or without prior notice.

3. Account Eligibility & Requirements
- Age Requirement: You must be at least sixteen (16) years of age to access and use our services independently. Registration or use by anyone under 16 without verifiable parental consent will result in immediate account termination.
- Accurate Information: You are required to provide accurate, current, and complete billing and contact information. Providing false, fabricated, or outdated information will result in immediate termination.
- Identity & Fraud Verification: We employ automated fraud-prevention systems to protect our infrastructure. In the event of a flagged or suspicious order, we reserve the right to require additional, non-intrusive verification, such as SMS phone validation or confirmation of billing address details. Failure to pass these fraud screening processes will result in order cancellation.
4. Payments, Billing & Cancellations
- Service Delivery: You are purchasing a license to rent server resources; all physical hardware remains the sole property of Cubes Hosting. Services are only provisioned once payment is cleared and/or manual verification is complete.
- Suspension & Termination: Invoices are generated 7 to 14 days before the due date. If an invoice remains unpaid, your service will be suspended 1 day after the due date. The invoice remains valid for 6 additional days; if unpaid after 7 total days past the due date, the service will be permanently terminated, and all data will be irrecoverably deleted.
- Cancellations: You must cancel services via the client area prior to your next billing cycle. You are solely responsible for canceling any active PayPal subscriptions.
- Pricing Changes: We reserve the right to modify pricing at any time. We are not obligated to notify customers if a price increase is less than 10% of the original service cost.
- Promotional Abuse: Abusing promotions (e.g., repeatedly canceling and reordering to secure a cheaper rate) is strictly prohibited.
5. Acceptable Use & Prohibited Activities
You are solely responsible for all content, data, and activities occurring under your account. To protect our infrastructure and other clients, you agree not to use our services:
- For any unlawful, fraudulent, harmful, or abusive purpose under Dutch, European, or local laws.
- To create, store, transmit, or promote Child Sexual Abuse Material (CSAM), terrorist content, extreme violence, or any other illegal material.
- To infringe on intellectual property rights, including hosting or distributing pirated content, unlicensed software, or stolen resources (e.g., BlackSpigot).
- To transmit viruses, malware, or other harmful code.
- To engage in spamming, unsolicited advertising, or bulk messaging.
- To conduct Denial-of-Service (DoS/DDoS) attacks, port scanning, or intrusive network testing.
- To conduct or attempt penetration testing or vulnerability scanning on Cubes Hosting infrastructure without prior written consent.
- To mine cryptocurrencies, operate trading bots, or run blockchain workloads.
- To host VPNs, proxies, adult material, or gambling platforms.
- In any manner that interferes with, degrades, or negatively impacts our physical infrastructure, CPU limits, or other customers' server performance (e.g., utilizing botnets or attempting to circumvent RAM/CPU restrictions).
Service-Specific Restrictions:
- File Storage: You may not use Game Servers to store personal files, non-server-related data, or to host non-specific services (e.g., running Web Hosting scripts on a Minecraft plan). You may not artificially inflate file sizes.
- Discord Bots: A standard Discord Bot plan is strictly limited to running a maximum of two (2) Discord Bots simultaneously.
- Backup Storage: You may strictly not store backups within your Game Server's live files. All backups must be managed via our designated Data Vault/Cloud Backup system or downloaded locally to your own computer.
Violation of any of the above clauses will result in immediate account suspension or termination without a refund, and may result in a report to law enforcement.
6. Backups & Data Security
- Client Responsibility: You are solely responsible for maintaining local copies and generating your own personal backups. We are not liable for any data loss, corruption, or hardware failure.
- Disaster Recovery: We perform automated, encrypted off-site snapshots of our core systems every 12 to 24 hours. These are strictly for internal disaster recovery and are not guaranteed or available for individual client restoration requests.
- Game & Bot Backups: We offer a specialized Data Vault for automated backups. Game servers include 2GB of free backup space, and Discord Bot plans include 500MB. The use of third-party backup plugins/scripts that save directly to the server's live files is prohibited to prevent resource abuse.
- Web Hosting Backups: DirectAdmin backup generation is permitted, but backup files consume your allocated service plan storage. (System disaster recovery snapshots do not apply to Web Hosting plans).
7. Limitation of Liability & EU e-Evidence
- Liability Cap: Under no circumstances shall Cubes Hosting be held responsible for damages, revenue loss, data loss, or downtime. Our maximum combined liability to a client for any service shall not exceed one hundred percent (100%) of the fee paid for that specific service in the month the incident occurred.
- EU e-Evidence Compliance (Regulation (EU) 2023/1543): We are required by law to comply with European Production and Preservation Orders issued by competent EU authorities. This may result in the immediate preservation, handover, or removal of your data without prior notice. Cubes Hosting is immune from liability regarding damages or interruptions resulting from such legal compliance. You agree to indemnify and hold us harmless from any claims or legal costs arising from law enforcement actions targeting your account.
8. Third-Party Agreements & EULAs
As a European provider, we act as the Data Controller for your customer account data, utilizing infrastructure processors (Hetzner and OXXA) under strict GDPR Data Processing Agreements (DPAs). By utilizing our services, you also explicitly agree to the following third-party agreements where applicable:
- Infrastructure: The Hetzner Terms & Conditions and OXXA Terms of Service.
- Game Publishers: The End User License Agreements (EULAs) of the games you host, including but not limited to the Minecraft EULA (Mojang AB), and the respective EULAs/Multiplayer Guidelines for Hytale, BeamMP, Palworld, Rust, Terraria, Satisfactory, and Unturned.
- Platform Services: The Discord Terms of Service (for Bot hosting) and DirectAdmin Terms of Service (for Web hosting).
9. Support & Fair Usage
Our support team operates during standard office hours. While we strive to provide reliable assistance, response times may vary, and we highly recommend consulting our knowledge base first. We are not obligated to provide support via private direct messages or personal social media accounts. All official support must be conducted via the official support methods.
